A photograph proves at most that an image was attributed to a booking. Match it to the booking number, release record, and court cause before drawing a conclusion.

Texas Business & Commerce Code Chapter 109 regulates covered businesses that publish criminal record information. It creates accuracy, correction, and removal duties in specified circumstances and bars covered fee practices for destroying, changing, or removing criminal record information. The chapter also provides civil remedies.
This law does not require the Upton Sheriff to publish a gallery. It also does not guarantee removal from a news archive or government file. Whether the law covers a publisher and whether a correction is due depends on the facts and current statute. Use the record's cause number, disposition, and release event when making a supported correction request.
Upton Expunction and Photo Access
Texas expunction under Code of Criminal Procedure Chapter 55A can direct covered agencies to destroy or return records as the statute provides.
